The HOA for Coco Marindo is very strict, which helps ensure the enjoyment of the property by all. This is a copy of the document that the security guard will ask you to sign when you arrive. We've provided it here, so you don't have to read it while checking in if you don't want to. Our goal is to allow you to have the information you need while making the check-in process as smooth as possible. Sometimes, the guards can be very stringent.

COCOMARINDO RULES

PREFACE

The goal of the Condominium Rules is to make Cocomarindo safe, secure, and enjoyable for all based on the Condominium By-Laws (Reglamento) and Costa Rican legislation in a fair, logical, legal, and enforceable way.

Understanding the difference between our By-Laws (Reglamento) and Rules is essential. The By-Laws were written and legalized when the condominium was registered. The By-Laws describe the way our Condominium Association is created and governed. The By-Laws (Reglamento) is an official document registered in the Public Register. The Rules are an internal condominium document describing the day-to-day life and the implementation of the By-Laws.

There are only two types of people in Cocomarindo: Owners and Guests. Renters and contractors are considered Guests of their owners. Owners are responsible for ensuring their Guests are familiar with the Condominium Rules and comply with them.

COMMON AREA

The General Common Area is occupied and used equally and freely by all owners and guests of owners. This is the entire area of the pool, rancho, parking lots, walkways, trees, and shrubs. The Preferred Common Area, as described in the minutes of AGM2022, may be occupied and used by the owner or guest of that unit only. The HOA and Management Staff may enter this area without permission to perform general duties and maintenance. This includes the second level 2-bedroom balconies, the first level 2-bedroom patios, the area in front of the window of the first level 1-bedroom, and all first level units for 1 meter in front of the rear patio door.

The occupants of this Preferred Common Area may barbeque, cook, smoke, play music, play with their pet, or engage in any other normal residential activity as long as they do not bother their neighbors. If a neighbor complains, they must either stop the activity or find a solution. This is known as the Good Neighbor Rule. Costa Rica law states that your right to pursue your activity does not supersede your neighbor's right to peace.

The Private Area is described as the area inside the unit. This is the private area of the owner or owner’s guest. The owner may remodel, change the color, etc., but no structural changes may be done according to By-Law articles 23 and 24.

Moral norms and good manners must be respected, and the tranquility of the property owners should not be disturbed in any way (By-Law, article 17). Inappropriate behavior, including aggressive, offensive, drunk, noisy, careless, or dangerous behavior, is not acceptable.

Glass and ceramic items are not permitted in the General Common Area.

Only certified propane and electric BBQs may be used in the Preferred Common Area. All barbeques must be operated safely and never left unattended.

Yelling, loud music, smoking (including e-cigarettes), idling cars, and any strong smells are not permitted in the General Common Area. Music is allowed when kept at a reasonable volume (reasonable shall be defined as not bothering other owners or guests) between 8:00 am and 10:00 pm (By-Laws, article 31).

Bicycles, motor vehicles (cars, trucks, motorcycles, scooters, golf carts, ATVs, and electric vehicles), toys, garbage, or other personal property must not obstruct entranceways, walkways, or sidewalks in the General Common Area.

Fireworks and the starting of fires are strictly prohibited. Please note the location of the fire extinguishers.

The outside parking is also considered a General Common Area of Cocomarindo.

Retail businesses are not allowed in the residential area of Cocomarindo, as per Article 27 of the By-Law.

Any Rancho event (library and pool bar) or activities with many people must be approved by the administration. A reservation request must be submitted to the HOA no less than three days before the event.

No rough play, running, kicking balls, or destructive behavior that is annoying or potentially dangerous to people or buildings is allowed in the General Common Area. No mechanized toys, including radio-controlled boats, drones, or cars, may be used in the General Common Area.

Ground floor units may not obstruct the path at the rear of buildings, including clotheslines. The area one meter outward from the rear patio door on lower units will be considered Preferred Common Area. Clotheslines are only permitted behind the building, where the laundry machines are located.

Towels, swimsuits, or clothing may not be hung on balcony rails.

Personal items such as tables and chairs may not be stored in the General Common Area.

Only the condominium administrator may install video cameras (except for the condominium security system) with the permission of the General Assembly (AGM) of the condominium owners. The installation of cameras should not capture the private areas of the condominium owners. Signs should be installed to warn people which areas are under video surveillance. The person responsible for the records assumes responsibility for the database and must guarantee the rights of access, correction, cancellation, and objection, as guaranteed by Law 8968 of Costa Rica.

It is forbidden in the General Common Area to wash, clean, or operate with objects that emit a strong odor or dirt. This also applies to commercial units. Any activity outside the commercial unit other than loading and unloading is prohibited without the Administrator's approval.

Illegal substances are not allowed to be used or sold on the premises.

Any landscaping, planting, or other work in the General Common Area must be approved by the Administrator (HOA Board) in advance. If written consent is not granted, the work can be removed at the owner’s expense.

GARBAGE / TRASH

Trash must be put in sealed plastic bags and deposited in trash cans. Trash bags or trash of any kind are not allowed to be stored on terraces, balconies, or at the back of units at any time (By-laws, article 28). Owners are responsible for the cost of removal of large items considered extraordinary. These items may include indoor construction materials, sinks, toilets, furniture, bedding, televisions, AC units, and appliances.

LAUNDRY

The laundry facilities are solely for the use of Cocomarindo owners and guests on a first-come, first-serve basis. Reservations are not permitted. Guests not staying in the condominium are prohibited from using the laundry.

SWIMMING POOL AND JACUZZI

There is no lifeguard on duty. Any person is individually responsible for all possible problems. Children under 18 years of age must be accompanied and supervised by a parent or competent adult at least 18 years old. Pool hours are from 7 am to 10 pm. Everyone must shower before entering the pool.

Use of the pool is prohibited when an individual cannot take care of themselves due to drug or alcohol intoxication, evidence of contagious disease, open wounds, or sores. No running, jumping, diving, or rough play is allowed in the pool, jacuzzi, bridge, or common area.

Bathing suits are required for all persons of any age. Babies must wear swim diapers. No nudity or sexual behavior is allowed in the pool or General Common Area. Glass and ceramic items are prohibited in the pool area and sidewalks. No food is allowed within one meter of the pool.

No furniture of any kind is allowed within one meter of the pool. No foreign liquids or substances may be spilled into the swimming pool or jacuzzi. All drinks must be kept a safe distance from the pool edge to prevent spills. Drinks are not allowed in the pool swimming area.

RESIDENTIAL USE

Any harmful or offensive activity within the condominium unit that can be a nuisance to neighbors or other units is not allowed. Defacing of property, such as signs, notices, advertisements, or any alteration of exterior surfaces, is not permitted. Temporary decorations installed seasonally or approved by management are excluded from this rule, as is the notice board at the entrance gate (By-laws, Article 26).

WILD / FERAL ANIMALS

It is prohibited to feed, touch, or manipulate wild or feral animals.

PETS

Costa Rica law does not allow pet restrictions in a home. However, pets are not permitted in the General Common Area or pool. Pets must be kept on a leash when traveling to and from the unit. Owners must pick up after their pets and keep their Preferred Common Area clean and free of pet droppings. My only reason it’s not 5/5 is the location. It’s a bit run-down near this property. But there is a good pizza place across the street as well as a bakery. And it certainly is close to the south end of the beach. The pool is fantastic.
